Order Terms

§ 1. Seller and contact details

§ 2. Website

1. The website operates at https://tawernarybna.pl.
2. The website enables, in particular, browsing the menu, making table reservations and submitting preliminary takeaway orders.
3. Use of the website requires a device with Internet access and an up-to-date web browser.

§ 3. Preliminary order

1. The customer selects products available in the takeaway menu and submits a preliminary order through the website.
2. Submission of a preliminary order does not result in an automatic payment being charged.
3. Submission of a preliminary order does not yet mean that the Seller has accepted the order for fulfilment.
4. The Seller may contact the customer to confirm product availability, quantity, weight, price, collection time or other elements of the order.
5. The sales contract is concluded after the details of the order have been agreed and the Seller has confirmed acceptance of the order for fulfilment.
6. The Seller may refuse to accept an order, in particular if a product is unavailable, preparation is not possible, or there is an obvious error in the price or description.

§ 4. Prices and products sold by weight

1. Prices shown on the website are gross prices unless otherwise stated for a particular product.
2. For products sold by weight, the price shown before preparation of the order may be an estimate.
3. The final price of such a product is determined after preparation and weighing.
4. The customer receives information about the final amount before making payment.

§ 5. Payment

1. No payment is charged when a preliminary order is submitted.
2. After the order has been agreed, the Seller may send the customer an individual online payment link.
3. Online payments are processed by Tpay.
4. Payment is considered completed after the Seller's system receives a valid confirmation from the payment operator.

§ 6. Collection and delivery

1. The customer may choose collection or delivery, provided delivery is available for the specified address.
2. Collection is free of charge and takes place at Tawerna Rybna Skipper, Krakowskie Przedmieście 116A/7, 32-087 Zielonki.
3. Delivery is provided within zones determined according to the distance between the delivery address and Tawerna Rybna Skipper.
4. The following delivery charges apply:
   • up to 4 km — 20 PLN,
   • over 4 km up to 8 km — 30 PLN,
   • over 8 km up to 15 km — 40 PLN.
5. Delivery is not available to addresses located more than 15 km from Tawerna Rybna Skipper.
6. For the purpose of determining the delivery zone, distance is calculated geometrically in a straight line between Tawerna Rybna Skipper and the coordinates of the delivery address. It is not a distance calculated along a driving route.
7. The delivery address is verified automatically. Based on the verified address, the system determines the delivery zone and delivery charge.
8. The delivery charge is added to the value of the products and forms part of the final order amount.
9. The customer should provide a complete and correct delivery address and, where necessary, information enabling successful delivery of the order.
10. The Seller may contact the customer if the address requires additional clarification or if delivery cannot be completed.

§ 7. Right of withdrawal

1. Consumers have the rights provided for under applicable consumer protection law.
2. The right to withdraw from a distance contract may not apply in cases provided for by law, in particular where the subject of the contract is goods liable to deteriorate or expire rapidly, or goods made to the consumer's specifications or intended to meet their individual needs.
3. Whether withdrawal is possible in a particular case depends on the type of product ordered and the way it was prepared.

§ 8. Complaints

1. The Seller undertakes to provide products that conform to the concluded contract.
2. Complaints may be submitted by e-mail to tawerna@tawernarybna.pl or in writing to the Seller's address.
3. A complaint should contain information enabling identification of the order and a description of the reported issue.
4. Complaints will be handled in accordance with applicable law.

§ 9. Personal data

The rules governing the processing of personal data are described in the Privacy Notice.

§ 10. Final provisions

1. Matters not regulated by these Terms are governed by the applicable provisions of Polish law.
2. These Terms do not limit consumer rights arising from mandatory provisions of law.
3. These Terms apply from 24 September 2026.
